Motorcycle Accident Insurance Problems

Insurance isn't likely to be the first thing most people think of after they've been in a serious motorcycle accident. Unfortunately, insurance is a very important part of any serious accident, because it provides the funding for the expensive medical treatment and repairs that victims need to get back on the road. If there's a dispute about insurance -- and there often is -- you could find yourself waiting months for payment of your claim, fighting a forest of red tape or defending yourself from an insurer's claim that you were at fault.

In any accident, one of the most important things to know about your insurance company is that it's there to make a profit. That means it's not necessarily on your side, especially if you have a very expensive claim. Some insurance agents will intentionally offer you a lower settlement than you're entitled to. A few may even try to incorrectly assign you the fault for the accident, or deny coverage in other ways. Most people don't realize it, but you have every right to politely reject their first offer and negotiate. If they won't negotiate, or if you need help, call Page || Cagle. Because we specialize in representing seriously injured accident victims, we have the legal knowledge, insurance experience and negotiating skill to resolve your claim favorably and quickly.

Another common problem for many riders is uninsured and underinsured motorists. Auto insurance is required by law in Missouri, but there's an increasing number of drivers who ignore that law. If you're hit by one of them, you may be stuck with the bills -- even if the driver was 100% at fault. Unless you have uninsured/underinsured motorist coverage or medical and collision coverage, the money may just not be available. You may believe you're fully covered -- but in Missouri, having all the legally required coverage doesn't cover your injuries, just those of anyone you might hit. This is also true when you were "hit and run"; insurance companies should treat this like a collision with an uninsured motorist, but they often refuse to. At Page || Cagle, we feel so strongly about this issue that we offer free consultations to riders who want to know more about what coverage will protect them fully.

Owners of customized bikes and other expensive types of motorcycle may also have trouble collecting payments for the full value of their vehicles. Insurance companies use standardized reference lists to come up with the value they assign your motorcycle, using only the make, model and year. But if you've made expensive modifications to your motorcycle, it's probably worth far more than its "blue book" value. You may have to show them receipts, sale prices for similar motorcycles or other documentation. Owners of expensive touring bikes and theft-prone supersports may also run into problems. If this sounds familiar, call Page || Cagle for help.

If you've faithfully paid your motorcycle insurance premiums, you've kept up your end of the contract with your insurance company. If they refuse to pay a legitimate claim, keep you waiting for weeks or undervalue your claim, they're not keeping up their end. If you think your insurance company is acting in bad faith, you have the right to answers. The experienced motorcycle accident lawyers at Page || Cagle can help.
